Terms of Service

1. Description of the Service

SegmentKit is a software-as-a-service (SaaS) platform that allows users to upload 3D models and automatically segment, process, or modify them for 3D printing and related purposes. SegmentKit does not manufacture physical products, operate 3D printers, or guarantee print success.

2. Eligibility

You must be at least 18 years old to use the Service. By using SegmentKit, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.

3. Accounts

To access certain features, you may be required to create an account. You agree to provide accurate and complete information, keep your account credentials secure, and be responsible for all activity under your account. SegmentKit is not responsible for unauthorized access caused by your failure to safeguard credentials.

4. User Content & Ownership

You retain full ownership of any 3D models, files, or data you upload ("User Content"). By uploading User Content, you grant SegmentKit a non-exclusive, worldwide, royalty-free, temporary license to process, store, and modify the content solely for the purpose of providing the Service.

You are solely responsible for the legality of your User Content, ensuring you have the rights to upload and process the content, and compliance with intellectual property laws. SegmentKit does not claim ownership of your models.

5. Prohibited Uses

You agree not to use SegmentKit to:

• Upload content you do not own or have rights to
• Violate intellectual property rights
• Create or distribute illegal, dangerous, or regulated items (including weapons or restricted components)
• Attempt to reverse engineer or disrupt the Service
• Abuse system resources or attempt unauthorized access

SegmentKit reserves the right to suspend or terminate accounts that violate these rules.

6. No Guarantee of Print Results

SegmentKit provides software output only. We do not guarantee printability, structural integrity, dimensional accuracy, safety of printed objects, or compatibility with specific printers or materials. You are responsible for validating all outputs before printing or use.

7. Payments & Subscriptions

If SegmentKit offers paid plans: fees are billed in advance and are non-refundable unless required by law, subscription terms renew automatically unless canceled, and we may change pricing with reasonable notice. Failure to pay may result in loss of access to paid features.

8. Intellectual Property

All SegmentKit software, branding, interfaces, and documentation are owned by SegmentKit and protected by intellectual property laws. You may not copy, modify, or redistribute any part of the Service except as explicitly permitted.

9. Service Availability

SegmentKit is provided on an "as is" and "as available" basis. We do not guarantee uptime, error-free operation, or continuous availability. We may modify, suspend, or discontinue features at any time.

10. Limitation of Liability

To the maximum extent permitted by law, SegmentKit shall not be liable for lost profits or data, failed prints, physical damage, personal injury, or indirect or consequential damages. Total liability shall not exceed the amount paid by you to SegmentKit in the previous 12 months.

11. Indemnification

You agree to indemnify and hold harmless SegmentKit from any claims, damages, or expenses arising from your use of the Service, your User Content, or violations of these Terms.

12. Termination

You may stop using SegmentKit at any time. We reserve the right to suspend or terminate access if you violate these Terms, required by law, or the Service is discontinued. Upon termination, your access to stored content may be removed.

13. Privacy

Your use of SegmentKit is also governed by our Privacy Policy, which explains how we collect and use data.

14. Governing Law

These Terms shall be governed by the laws of United States, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of SegmentKit after changes constitutes acceptance of the updated Terms.
